I will be in Austin a few days this week discussing a couple of proposed bills with a number of House and Senate members.
A rough draft of one of the proposed bills is below.
Summary: There are a total of 254 counties in Texas. Of these counties, there are specifically 4 metropolitan counties, Bexar, Dallas, Harris and Travis, that have populations that are large enough that, when combined, can amend the Texas State Constitution at will. This formula basically leaves every rural county in Texas, plus Tarrant County, without a voice,
The proposed bill would amend the Texas State Constitution to require any proposed amendment receive approval of three fourths of the counties in order to be ratified. This would simply mimic the amendment requirement used in the federal Constitution and give a voice to those Texans who are currently not represented in the process.
DRAFT TEXT:
A JOINT RESOLUTION proposing a constitutional amendment, changing the process in which the Texas Constitution is amended, in order to give equal representation to the citizens in each county.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1-C, Article 17, PROPOSED AMENDMENTS;
PUBLICATION; SUBMISSION TO VOTERS; ADOPTION, is amended to read as follows:
Sec. 1. (c) The election on shall be held in accordance with
procedures prescribed by the Legislature, and the returning officer in each county shall make returns to the Secretary of State of the number of legal votes cast at the election for and against each amendment for each county. If it appears from the individual county returns that a majority of the votes cast in 190 individual counties, being three-fourths of the counties in Texas, have been cast in favor of an amendment, it shall become a part of this Constitution, and proclamation on thereof shall be made by the Governor.
SECTION 2. This proposed constitutional amendment shall be submitted to the voters at an election to be held November 7, 2017. The ballot shall be printed to permit voting for or against the proposition: “To change the process in which the Texas Constitution is amended, in order to give equal representation to the citizens in each county.”
